Getting your records back from a strata manager
Short answer
The scheme's records belong to the owners corporation, not the manager. When an appointment ends, ask in writing for every record, the bank accounts and keys by a set date. If they still aren't handed over, the dispute body in your state can order it.
Steps for your committee
- Write to the outgoing manager listing every record you expect and a reasonable deadline.
- Include minutes, registers, financial records, bank statements, insurance, contracts, plans and correspondence.
- Arrange transfer of trust or bank accounts and any funds held.
- Tick off each item as it arrives and note anything missing in writing.
- If records are still missing after a reminder, apply to your state's dispute body.
Checklist
- Roll / owner register
- Minutes and resolutions
- Financial statements and bank records
- Insurance policies and valuations
- Contracts, warranties and plans
- Keys, fobs and passwords
